CITIZENS ADVISORY COMMITTEE TO REGIONAL PLANNING COUNCIL

 

APPLICABILITY OF FINANCIAL DISCLOSURE LAW

QUESTION:

 

Are the members of a citizens advisory committee to a regional planning council "local officers" for purposes of filing financial disclosure?

 

Your question is answered in the affirmative.

 

In your letter of inquiry you have stated that the members of the Coastal Zone Citizens Advisory Committee have been appointed by the Treasure Coast Regional Planning Council pursuant to the requirements of the Federal Coastal Zone Management Act of 1972. You have also stated that the advisory committee simply provides input to the regional planning council so that the council can perform its functions in coastal zone planning and that the advisory committee does not take any binding final action on its own initiative but, instead, makes recommendations to the regional planning council.

Your question is answered in the affirmative, based upon the rationale contained in a previous opinion of this commission, CEO 76-61, a copy of which is enclosed.
